Closed Claim Summary – Dental
Lack of Informed Consent for the Removal of
Teeth
 A 37 year-old dental phobic male presented to our
insured’s office with extensive caries on teeth #’s 2, 3, 14, 18 and 30, and
tooth #24 was not present. He also had extensive bone loss around lower anterior
teeth. On this initial consultation, the insured took four bitewings and two
periapicals and completed the fillings on 2, 3, 14, 18 and 30. Our insured
planned on extracting teeth #’s 20, 23 and 25 due to Type II perio and
installing a flipper to replace them (and the missing #24).
